CONDITIONS FOR USE - WEARLENSES.CO.UK

1. AREA OF APPLICATION

The following conditions for use supplement the contractual relations between the sales partner and ALCON Pharma GmbH, Blankreutestra?e 1, 79108 Freiburg i. Breisgau regarding the use of InContact.

 

2. USE AND PUBLICATION OF DATA

ALCON uses the names, business address and business contact data of the sales partner in order to display the location of the sales partner on a map to end consumers. Using a search mask, end consumers can search for participating sales partners within a certain defined radius, and subsequently select them. The use of the data mentioned here serves to display the exact location of the participating sales partners to end consumers. The end user can subsequently select a participating sales partner. The sales partner hereby declares itself expressly in consent, and will immediately communicate to ALCON any changes of name, business address and/or other business contact data.

 

3. RESPONSIBILITY FOR DATA PROTECTION

The sales partner is the agent responsible for data protection of the collection, processing and use of personal data on the platform kontaktlinsen-tragen.de in the sense of the Federal Data Protection Law. ALCON acknowledges the necessity of entering into an agreement for contract data processing. A corresponding sample agreement is made available to the sales partner as an electronic document. We use the contact data provided by the sales partner in order to optimally inform you of our product innovations. Sales partners have the opportunity to object to the use of the disclosed data at any time.

 

4. RESPONSIBILITY FOR SELF-DESIGNED SUBPAGES, GRANTING OF RIGHTS TO USE

The sales partner shall be responsible for self-designed subpages (digital showcase). In particular, the sales partner must ensure that the content it posts is free from rights of third parties. The sales partner assures that it has acquired all necessary rights and approvals prior to posting content. By posting pictorial content, the sales partner transfers a cost-free, non-exclusive, worldwide, objective, content-related and temporally unrestricted right to ALCON and its affiliated companies to make use of the posted content to render the service. If ALCON is made aware of a legal infringement (e.g. copyright infringements of the images used by the sales partner), ALCON shall be entitled to remove the corresponding contents. ALCON shall notify the sales partner that the latter is obligated to keep a provider designation (legal notice) on the self-designed subpages in accordance with ? 5 of the Telemedia Act.

 

5. INFORMATION REGARDING REIMBURSEMENT

In order to receive a reimbursement, it is necessary to provide valid banking details (IBAN). The sales partner ensures the exclusive use of its own business account for the repayment function. No payments shall be made to private accounts or to the accounts of third parties. Upon suspicion of abuse, ALCON shall be entitled to have the transactions reviewed by a third party (e.g. auditor). If irregularities are discovered, the sales partner must pay the costs for this audit. The fiscal appraisal of the reimbursement is solely incumbent on the sales partner.

 

6. REGULATIONS FOR APPROPRIATING CUSTOMER DATA WHEN CHANGING OPTOMETRISTS

At any time, end consumers may change their selected sales partner. Upon a change of the end consumer, the surrendering sales partner guarantees all of the data will be forwarded to the newly selected sales partner.

 

7. FINAL PROVISIONS

ALCON reserves the right to discontinue the services offered at any time. ALCON is entitled at any time to change the conditions of use. If ALCON changes the conditions of use, the sales partners will be informed of the changes. From this point in time, the sales partners shall be able to object to the change within 30 days. After expiry of the aforementioned period, the updated conditions of use shall apply. If the sales partner objects to the changes, ALCON is subsequently entitled to terminate the user relationship without observing a notice period.
